Matthew helps clients achieve their commercial objectives in all areas of property litigation, including contentious landlord and tenant work such as business lease renewals, trespass claims, break clause disputes, tenant arrears/insolvency, landlord consents, dilapidations claims, rent reviews and right to manage and service charge disputes.
He also has considerable experience of handling high value cases for clients which result in lengthy High Court and Upper Tribunal (Lands Chamber) trials. He also has a broad experience of alternative dispute resolution processes, including mediations.
Matthew works closely with the transactional real estate team and has wide experience acting on large scale development matters, including rights to light negotiations/settlements, boundary/party wall issues and sale and purchase disputes, business rates advice and disputes, vacant possession strategies and possession proceedings to remove squatters from commercial premises.
Matthew is also a member of Herbert Smith Freehills' Trust, Asset Tracing and Fraud Group, the Business Rates team and advises clients on property law issues in the context of fraudulent transactions.
Matthew's experience includes advising:
- Canary Wharf Group in its multi-million pound claim for unpaid rents and other damages resulting from the Lehman Brothers administration
- TAG Farnborough Airport in defending multi-million pound claims by local residents for compensation under the Land Compensation Act 1973 for disturbance/diminution in value of their homes resulting from airport works
- Institutional investors in numerous asset management matters including disputed break notices, contentious applications to underlet, dilapidations claims, tenant arrears/insolvency and enforcement
Matthew holds a Master of Arts (Law) from Emmanuel College, Cambridge and graduated with First Class honours. He is also a qualified Solicitor Advocate with higher rights of audience and a member of the Property Litigation Association.
