Benjamin Smith
Benjamin is an experienced commercial litigator specialising in class actions and large-scale disputes across a variety of industries, including in banking, construction and financial services. Benjamin also advises clients in relation to regulatory investigations and related matters.
Benjamin has extensive experience acting in proceedings in most major jurisdictions (particularly the Supreme Court of New South Wales and the Federal Court of Australia) concerning alleged breaches of statutory obligations, including proceedings involving actions under the Corporations Act and the Australian Consumer Law.

Benjamin holds a Bachelor of Laws and Bachelor of Arts from the University of Newcastle.
Benjamin was admitted as a solicitor of the Supreme Court of New South Wales, and is qualified as an Australian legal practitioner in New South Wales and the High Court of Australia.

- defending a securities class action brought by multiple plaintiffs in the Supreme Court of New South Wales, in relation to alleged breaches of continuous disclosure obligations and misleading or deceptive conduct;
- representing the respondent in class action proceedings in the Federal Court of Australia in relation to financial reporting matters in its overseas operations;
- acting on behalf of a banking client in relation to an investigation being conducted by ASIC, including attending and advising upon compulsory examinations; and
- acting on behalf of a large contracting company in multi-party proceedings brought by the Commonwealth of Australia
