There were several high profile trade mark cases in 2017 and we have put together a summary of our top trade mark cases from the last 12 months. 

Key developments include the Supreme Court finding that there is potential criminal liability for dealing in parallel imports under section 92(1) the Trade Marks Act 1994 and the Court of Appeal making it ever more difficult for brand owners to obtain shape mark protection in light of its judgments on acquired distinctiveness.
