Legal Briefings – By Stephen Wisking, Partner, Kim Dietzel, Partner and Molly Herron, Senior Associate/PSL

The deadline for implementation by EU Member States of the EU Damages Directive in respect of private competition law damages claims was 27 December 2016.

This chapter outlines the current private enforcement landscape in the EU and the changes made by the Directive, including in respect of limitation, document disclosure, joint and several liability, contribution, and settlements. It also considers the implementation status across the EU, and the likely impact of the Directive's provisions on the private enforcement of competition law.
