The recent English High Court decision in the latest round of the Pugachev legal proceedings has grabbed the headlines and reignited the debate around sham trusts.

However, sham was just one aspect of the most recent decision. In a long and complex judgment the judge actually primarily reached his decision on the basis of what he described as the "True Effect of the Trusts" - the result of which was that the settlor was found to be the beneficial owner of the assets settled onto five New Zealand law trusts.
